Rules and conditions for using Condo Move as a CRM and lead generation service

Condo Move (“Condo Move,” “we,” “our,” or “us”) provides (1) customer relationship management tools (the “CRM”) and (2) lead generation and routing services (the “Lead Gen”) for moving and related service businesses (collectively, the “Services”).

These Terms of Service (“Terms”) form a binding agreement between Condo Move and you (“you,” “Customer,” or “User”). By accessing or using the Services, creating an account, accepting leads, or otherwise using Condo Move, you agree to these Terms. If you are using the Services on behalf of a company, you represent that you have authority to bind that company to these Terms.

2.1 CRM Features

The CRM may include features such as contact and lead management, pipelines, notes, tasks, call/SMS/email logging, reporting, calendars, and automations. CRM features may change over time as we improve the Services.

2.2 Lead Generation Features

Lead Gen services may include receiving, viewing, purchasing, accepting, rejecting, and managing leads; lead routing; matching based on service area and availability; and integrations that deliver lead information to your account.

5. Leads: Delivery, Use, and Quality

5.1 Lead Information

Leads may include contact details and moving request details provided by the consumer (e.g., name, phone, email, origin/destination, move size, dates, and notes). Lead content may vary and is provided “as is.”

5.2 No Guarantee of Outcomes

We work to generate and route leads, but we do not guarantee: (a) lead volume, (b) conversion rates, (c) revenue, (d) exclusivity, or (e) that a lead will result in a booked job.

5.3 Lead Response Expectations

You agree to make commercially reasonable efforts to contact and service leads promptly. Delayed follow-up may reduce lead value and customer experience.

5.4 Prohibited Uses of Leads

You may only use lead information to respond to the consumer’s request and to provide related customer service. You must not sell, share, or reuse lead information for unrelated marketing or third-party promotions.

6. Pricing, Billing, and Refunds

6.1 Fees

The Services may include subscription fees (CRM), usage-based fees, and/or per-lead charges (Lead Gen). Fees, taxes, billing cycles, and payment terms will be presented in your account, order form, or subscription screen.

6.2 Payments

You authorize Condo Move (and our payment processors) to charge your selected payment method for all applicable fees. If payment fails, we may retry charges and/or suspend access until payment is received.

6.3 Lead Disputes / Credits

If Condo Move offers a lead dispute or credit policy, it will be described in your account or help documentation. Any credits or refunds (if offered) are at Condo Move’s discretion and may be subject to time limits, documentation requirements, and verification.

6.4 No Chargebacks Abuse

Fraudulent chargebacks or repeated abuse of disputes may result in suspension or termination.

7. Integrations and Communications

The Services may integrate with third-party tools (e.g., email, SMS, telephony, calendars, analytics). Your use of third-party services is governed by their terms and policies, and Condo Move is not responsible for third-party outages or changes.

If you enable calling/SMS/email features, you are responsible for obtaining any required consents and complying with applicable communication laws and carrier policies.

8. Data, Privacy, and Security

8.1 Your Data

Customer Data” includes information you upload or generate in the CRM (contacts, notes, messages, files, pipeline data) and data you receive through Lead Gen. You retain ownership of Customer Data as between you and Condo Move.

8.2 Our Use of Data

We use Customer Data to provide, maintain, and improve the Services; prevent fraud and abuse; troubleshoot; support customers; and comply with legal obligations. We may use aggregated and de-identified data for analytics and product improvement.

8.3 Privacy Policy

Our handling of personal information is described in our Privacy Policy. If there is a conflict between these Terms and the Privacy Policy regarding personal information, the Privacy Policy governs.

9. Intellectual Property

Condo Move and its licensors own all rights, title, and interest in and to the Services, including software, branding, and documentation. You receive a limited, non-exclusive, non-transferable, revocable license to use the Services during your subscription term in accordance with these Terms.

You may not use Condo Move trademarks without prior written permission.

10. Confidentiality

Each party may receive confidential information from the other. You agree not to disclose Condo Move’s non-public information (including pricing, lead sourcing, algorithms, or technical details) except as required by law.

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Condo Move disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Condo Move does not warrant that the Services will be uninterrupted, error-free, or that leads will meet your business needs.

13. Limitation of Liability

To the maximum extent permitted by law, Condo Move will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities.

To the maximum extent permitted by law, Condo Move’s total liability for any claim relating to the Services will not exceed the amounts paid by you to Condo Move for the Services in the three (3) months before the event giving rise to the claim.

14. Indemnity

You agree to indemnify and hold harmless Condo Move, its affiliates, and its directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services, (b) your communications with leads/customers, (c) your services provided to customers, or (d) your violation of these Terms or applicable law.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of the Services after changes become effective indicates your acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the applicable Canadian province/territory in which Condo Move operates, and the federal laws of Canada applicable therein, without regard to conflict of law principles.
